Terms of service

These terms are an agreement between you and [LEGAL ENTITY NAME] ("OdysseyCMS", "we") for the use of the OdysseyCMS service. By creating an account or using the service, you agree to them. If you accept on behalf of a company, you confirm you can bind it.

1. Your account

You must give accurate information and keep your login details secure. You are responsible for activity under your account and for the people you invite to your sites, including the roles you give them. Tell us promptly at [SUPPORT EMAIL] if you suspect unauthorized access.

2. Servers and storage

Your sites run on a server you choose from our pricing page, or on a server you already have with us. Pages, users, sites and custom domains are not metered. Images and files can be kept on the server or on Cloudflare R2, which is billed by the gigabyte stored each month.

3. Billing

Servers are billed monthly in advance, in euros, at the prices on our pricing page when you subscribe. A longer contract term gives a lower monthly price for the whole term. R2 storage is billed monthly in arrears for what was stored. Prices exclude taxes, which are added where required. Subscriptions renew automatically until canceled.

A server has the capacity of its size. If your sites outgrow it, you can move to a larger server.

We may change prices with at least 30 days' notice by email. Changes apply from your next billing period.

4. Acceptable use

  • Do not publish unlawful content, or content that infringes other people's rights.
  • Do not use the service to send spam, distribute malware or run phishing pages.
  • Do not try to access other customers' sites or data, or probe, overload or disrupt the service.
  • Do not resell the service except by building and managing sites for your own clients.

5. Your content

You keep all rights to the content you put on OdysseyCMS. You give us a license to host, copy, process and display it only as needed to run the service for you. You are responsible for having the rights to your content and for the data your forms collect, including giving your visitors any required privacy notices.

6. The service

We work to keep OdysseyCMS available, secure and backed up daily, and we may improve or change features over time. We will not remove a core feature during a paid period without notice. Unless a separate written agreement says otherwise, the service does not come with an uptime commitment or service-level credits.

OdysseyCMS, its software and its branding belong to us. These terms do not give you rights to them beyond using the service.

7. Cancellation and termination

You can cancel at any time. Your server continues until the end of the period you have paid for, or of the contract term you chose, and is not refunded for unused time, unless the law requires otherwise.

We may suspend or close an account that breaks these terms, puts the service or other customers at risk, or remains unpaid, and will give notice where we reasonably can.

After an account closes, you can request help exporting your content for [N] days. After that, we delete it, subject to the backup rotation described in our privacy policy.

8. Warranties and liability

The service is provided "as is". We do not guarantee any search ranking, traffic or business result. To the extent the law allows, our total liability under these terms is limited to the amount you paid us in the 12 months before the claim, and neither party is liable for indirect or consequential losses. Nothing here limits liability that cannot be limited by law.

9. Changes, law and contact

We may update these terms and will give at least 30 days' notice of material changes by email. These terms are governed by the laws of [JURISDICTION], and disputes go to the courts of [VENUE]. Questions: [LEGAL CONTACT EMAIL], [REGISTERED ADDRESS].
